  • How do I find out If I owe money to NYC over a towed vehicle that was auctioned?

I owned a vehicle that slowly broke down over 2 and which became inoperable. Long story short, I stopped moving it for street cleaning (it was unsafe to drive) and left it for a period of 3 weeks due to the weather which dumped a blizzard on the c...

You have bigger problems than trying to collect the difference between the auction price and the balance due and owing. When a car is deemed abandoned the DMV is notified and the registered owner's license is suspended. In addition if your plates were not turned into the DMV your license is again suspended due to an insurance lapse, as I am sure you failed to pay insurance premiums on the vehicle after it disappeared. You can hire a lawyer that specializes in speeding and traffic ticket defense to run your plates and license, see if you are suspended or revoked, and also run the VIN of the car to find out who it was sold to and through that method you can also find out the sale price..

Suppose your car needed a tune up. Would you call a mechanic and tell him the make and model of your car and then ask him to tell you how to do a tune up so you could do it yourself? Probably not, however that is exactly what you are doing here. You are telling us the make, model and year of your problem., and asking on detailed instructions on the dos and don't, advantages and disadvantages, and the "how to" to do it yourself. No, that's not how this works. We are not here to give you a written "how to" manual. We are here to answer questions about consequences to convictions and what a lawyer can do for you should you choose to retain one. Believe me when I tell you - you need a lawyer. Badly. Get one. Or, if you don't want to retain counsel hit a law library and start learning the answers to your questions.

    Michael’s Answer

You don't even know how bad it is. If you plead guilty you will lose your license. And "see the prosecutor," no, you are not going to "see the prosecutor," you are going to conference the matter with your advisory. You are in a venue as a kid whereby a lot of very smart and aggressive people who do not have any concern about you are in charge of. Doing this yourself is like leading the sheep the slaughter. The only thing the prosecutor respects is strength. Since you have none, you are going to get swatted around like a cat swats a mouse. Do yourself a favor, call your parents and have them retain a lawyer for you. You have no idea of the long and painful road ahead of you if you go in their exposed.

  • Question pertaining to getting my license back. It has been suspended for a year due to a DWI.

    Michael’s Answer

I am sure your lawyer was a very good attorney, but most DWI lawyers do not understand the regulations regarding the interlock. You need to find a lawyer that knows the regulations and can deal with the DMV and probation on this matter.
