Client (who was asserting his claim that he was a Naturalized Citizen of the United States) was being detained under recently passed "mandatory detention" requirements. The court held that the mandatory-detention requirement violates
substantive due process because it incarcerates all immigrants who
are in INS removal proceedings without regard to whether an
individual alien poses a flight risk or a danger to the community.
