Is it best to appeal?: My children were removed from my home a month ago because a referral they received from a hospital. I gave birth to a still born, 22 weeks, I did not have any prenatal care because i wasnt even aware of the pregnancy. I tested positive for meth. I havent done drugs for a long time its been from the beginning of this year, ive had. DCFS called me a functional user. I have no priors, ive been living in same home for 11 years, my children are healthy enrolled in school, I'm employed im a supervisor for the last 3 years. Im not using drug nor would i put my children in danger. Should i appel.

Evelyn’s answer: Whether or not you should appeal is impossible to tell based on the information you have provided. You need to work with your attorney to resolve the case as favorably as possible for you and your family.

If you do not agree with the recommendation of the department (CPS) then you have the right to set the matter for trial and present evidence to the court to persuade the court to make an order that you agree with. Once the court makes an order - if you do not agree with the order - then you may appeal.

Talk with your court appointed attorney or find a private Juvenile Dependency attorney in your area to help you.

How long does cps have to file petition against a parent when they remove their child ?: 6 days ago cps removed my child from my care and had me arrested under false child crulety charges. that came from a third party that lied in order to have control over my kids, i went to jail and was given a paper saying i could not contact my kids DA did not file charges against me and after 5 days i was released. As of today cps has not contacted me about any court date in regards to my children i am a good parent so why cant i have my children returned to me?if cps fails to file petition by certain time will my kids be returned to me ?

Evelyn’s answer: When the government (CPS) takes your children in to protective custody they have 72 hours to file a petition which triggers a Detention hearing in superior court. Once in court you have the opportunity to address a judicial officer about the facts. You are also appointed an attorney at that hearing.

Right now is a time when the government (CPS) has the most power because no one is overseeing what they are doing, they are likely interviewing your children for information to use against you. It can be ugly, especially if the charges are truly false as you claim.

However - if your children are truly at substantial risk of harm in your care - then CPS is doing exactly what it is supposed to do - protect children.

You say CPS has not contacted you. What have you done to contact CPS? You should be knocking on EVERY door - Banging on every door! Get your children back now. Speak with a Juvenile Dependency attorney in your area and have them assist you in dealing with your local CPS agency.

If that paper you were given is a restraining order - read it carefully. Is it a court order? Is there a court date? Hire an attorney.
