Has the district attorney made any offers to settle the case? Were those offers analyzed by an immigration attorney? Does your brother's defense attorney know he is not a citizen? Has your brother's defense attorney suggested that your brother should speak with an immigration attorney?
I don't believe a conviction for vehicular manslaughter would automatically block your brother from obtaining a green card through marriage, but an adverse moral character determination could be grounds for the government to deny the application.

Is it okay to travel for parents on visit visa to the US while your ds262 form has been submitted?: We are in the middle of immigration proceedings for our parents. Their DS262 form and other docs were recently submitted. My mom has a valid visit visa and we would like to confirm if its okay for her to visit us here. We are not sure as during change of status, you are expected to not leave the home country.
Thomas’s answer: Yes they can travel here but make sure they have proof of return. Now they have expressed an immigrant intent by you petitioning for them and some CBP officers are jerks when people enter.
