Can I get my driver's license in California?: I have had 2 DUIs within 5 years in the State of Florida, my license is currently revoked. My 2nd DUI had "No Action Taken" on charges recently; so, the State has decided not to pursue any formal charges regarding the matter (incident occurred 3 years ago). I currently live in California and would like to know what my legal options are to obtain a California driver's license.

Aaron’s answer: California DMV will need to see no suspension from another State before issuing you a CA license. You need to talk with DMV in Florida to determine what is keeping you from getting the suspension lifted. Usually it is completing a DUI School, paying a fine, SR-22 insurance or it could be other reasons. Even if the DA did not file charges on the 2nd DUI, there was probably a DMV action taken and that may be the issue. If you cannot figure this out by contacting DMV in Florida, you may want to get a Florida DUI Lawyer to help.

Can I get a restricted license in CA if my license is suspended in another state?: I recently moved to CA and just found out my FL license is suspended due to unpaid court costs. Can I get a restricted license in CA even though I’ve never had a CA license?

Aaron’s answer: If California DMV sees the Suspension they most likely will not issue any license, including a temporary or restricted license. Florida is part of the interstate compact so most likely this will show up with CA DMV when you try to get a CA license. You can check with DMV Mandatory Actions in Sacramento at 916 657-6525 or just go into a local DMV field office to see if you can get a CA license. Most likely you will need to clear the out of state suspension before legally driving in CA. Good Luck

Do you have to do your dui classes in the county you were charged in?: I live in San Bernardino county now but back when I got my dui’s I lived in Orange County and it was an Orange County court that requested 18 months of dui classes. Do I have to do my classes in Orange County or can I do them in San Bernardino county? Also I was given 6 months to sign up but had no money to pay for the classes since I couldn’t find work. I now have a job and can pay. Do I have to reinstate my classes or can I just start them? Who would issue me my restricted license if I was able to start the classes? Thank you.

Aaron’s answer: During Covid most counties in CA have allowed people to do their classes in any county in California. Many DUI Schools shut down for good or were delayed in getting classes started again after an initial shutdown. When Covid began the DMV encouraged all the schools to begin remote/zoom online classes. These classes have continued in most counties to this day and there is no end time in site for online classes. Due to the delay in signing up caused by less available schools, the Courts in most counties have encouraged people to sign up for any school they can in any county as long as it's a DMV certified CA school. You should check with your attorney or if they do not know then your Court Clerk's office to confirm you're good doing a school in another county.

Regarding signing up after the six moths they gave you, again check with your attorney and if they do not know then the Clerk's office regarding if you need a new referral. Many DUI Schools do not require a court referral to sign up, and technically they should not need one to sign you up. Good luck.
