WC traumatic brain injury CDL revoked :
I had a propane cylinder blow up around my head and have been off almost 2 years now. I have a TBI and neurological problems. I think I’m developing Parkinson’s disease from this but I’m
Not sure. I had MDE which detected a lot of neurological issues and they suspect I have seizures now as a result of this work injury. I am a truck driver and will likely lose my CDL and possibly my regular license as well. Is it that one is entitled to lifetime benefits provided they find me permanent / stationary after a rehabilitation program ? I have post concussive syndrome and a host of fun mental health challenges now ... I survived a BLEVE explosion that was horrendously powerful and basically neurological seizures are preventing me from driving and everything else makes existence miserable. I’m just wondering what it’s looking like here I have 4 decades of wages left to earn at six figures each year ... not likely anymore.
Scott’s answer:
This is one of those times that you should at least discuss with an attorney the various aspects of your injury, even if you don't hire one. You may need a 3rd party attorney, workers compensation attorney as well as one in relation to your licenses. You will need to have someone fight for your benefits as the insurance company certainly will have a team on their side!
Good Luck!
Should I chose PSY or MPD for QME panel?:
I have a delayed worker's comp claim. It is due to stress. I was seeing someone in Behavior Medicine at Kaiser as of 01/28/21 and was placed off of work. I recently received the notice to request the QME panel and was told by the insurance it had to be completed in order to re-activate the delayed clalim. I am unsure if a MPD or PSY should be selected and/or the process going forward. Any advice would be greatly appreciated.
Thank you.
Scott’s answer:
It really depends on your where you live and what doctors will come up in that area. I suggest you get a consultation with an attorney. Even if you do not retain an attorney, they may be able to help you pick your specialty.
Good Luck!
Will I still be eligible to be covered by my companies health/dental coverage, if my workers comp has reached it's time limit?:
I got injured on the job and became temporary permanently disabled. I was collecting workers compensation, however, I reached the maximum limit of what workers compensation will cover. I have still not been approved to go back to work.
I am signed onto my companies health and dental coverage. Will I still be able to utilize the health and dental coverage even though I have not returned to work?
Scott’s answer:
It really depends on your employer and their policies. If you have a union, you may want to follow up on what the policy is. Mr Borah is correct, in most cases, this may be considered a gift as they are not required to continue your coverage. If you have an attorney, you should talk to them and start to plan either a return to work, or whether you will be out for an extended time and may need to look into Medi-cal or social security disability and Medicare if you will be out for an extended period.
Good Luck!
