Joseph’s answer: I suspect the lawyer wants you to select a vocational training counselor under Family Code Section 4331. I also suspect the assessment is to determine your ability to obtain employment that would allow you to maintain the marital standard of living. If you are not going to hire a lawyer for representation, searching online for court-approved experts is a good place to start.

Joseph’s answer: There are many factors to consider. Nothing is absolute in family law. You have a good portion of time with the child. You really should respond to his request by filing the appropriate documents etc.

My attorney quit and court is 2 days away, what now?: I have been going through a child support/custody case. The other parent of my child is trying to take me to the cleaners financially and refuses to work. My attorney has been very ill and just told me that he cannot work my case any longer. The opposing side has filed a proposed agreement that is unreasonable and financially hurtful to me. What are my options? Court is in 2 days.

Joseph’s answer: An attorney can fire a client just as a client can fire an attorney. The timing might be bad depending on the type of hearing. However, an ill attorney has a good excuse, depending on the illness, to stop representation. You probably want to hire a healthy attorney anyway. If you have a trial in a couple of days, you or your attorney probably should ask for a continuance due to the lawyer's illness. Your lawyer may have you sign a substitution of attorney. More facts are required to provide a thorough analysis.
