My boyfriend does not want to sign our baby’s birth certificate. Is he right?: My boyfriend does not want to sign our baby’s birth certificate because he feels he is going to be charged or have to pay child support even tho I’m fully insured and we currently live together, he thinks he’s gonna have to pay all hospital fees and pay the government…. Is he correct?

William’s answer: Irrespective of whether your boyfriend signs his child’s birth certificate, the California Department of Child Support Services or you can establish his paternity to address child support and birth expenses. I can provide much more detail if you elect to reach out to me.

Can I sue my property manager because apartment has mold? We have proof (pics, video, even a professional report paid by us): My girlfriend lived on that moldy condo from 6/12 to 12/12... Gabriel (10 yrs Son) had several months of a unstoppable couch and we even had a doctor's note saying it was because of mold. We had to move during X-mass and New Years, We just recently were able to have internet installed in our new apartment (same complex we want to sue) we really want to ask some lawyer to help us on this us. We feel that since the beginning of the rental from the Cardiff Apartment my girl, ISIS, had trouble. Maybe its because of her language barrier, I don't understand. Isis is now 3 months pregnant, we had to rush to emergency and she almost lost our baby after the mold / move situation... it was very stressful what happened to say the least. I would love to have to guidance, and I appreciate your help.

William’s answer: Several pieces of important information are necessary before a qualified attorney can effectively advise and direct you. You should be able to locate an attorney in your area who will provide you a no-cot initial consultation and who has previously handled claims arising out of mold. Important information includes the following: (1) the date, substance and manner in which you provided notice to the property manager and/or residential property owner; (2) the content and quality of the mold report; (3) the expertise of the author of the mold report; (4) the documentation of the impact of the mold on the health of any family members, including lab reports; and (5) the expertise of the doctor (as to mold) who made the connection.

Can my wife take my kids and leave the country?: My wife and I are having marriage issues, and she always threatens me to take our two girls out of the country and go back to Syria (where we both come from) to live with her father and sick mother (Sever Depression) I can’t imagine the girls life in this environment. Her father is a powerful man in Syria, and they can prevent me from seeing the girls ever again. I was laid off I have a worker’s comp case for my hand injury and I’m close to getting an AA degree in Accounting. I have a very good relationship with my girls; My wife just got a new full time job last month and I have been babysitting the girls most of the day (8 hours and more) which made my relationship with them develop even better.
So can my wife take the kids out of the country and prevent me from seeing them?

William’s answer: The US wil require your children to have passports. If they possess passports, the best way to insure that their mother does not take them to Syria is to file a Summons and a Petition in the Superior Court for a legal separation AND have your wife personally served with them. The reverse side of the Summons contains restraining orders that are automatically in effect as to both of you. One of those restraining orders bars both of you from removing the children from the county without first obtaining a court order or written permission of the other parent. You can also accompany the Summons and Petition with a Motion to obtain temporary orders; that Motion will be calendared for a hearing and will be preceded by a mediation in the courthouse with a member of "Family Court Services" where the Motion includes the issue of child custody and related child issues.

If you cannot afford an attorney, there is a Family Court Facilitator in each courthouse available to assist you in preparing the necessary papers, e.g. the Summons, Petition, Motion, etcetera. However, there is a long line of people seeking this free service and only a few of them are seen each day.
