Allocation of parental responsibilities: If I sign and the mother signs in agreement and I leave the state after the courts approve our agreement will I lose all my rights. If we agree to share time and I need my time spent in another state with my child would I be allowed to do so? If so what would I need to request. If I file for parental responsibilities and move out of state for work purposes would this affect my case?

April’s answer: A parent can always ask the court to order out of state parenting time if he or she lives or relocates outside the state if Colorado. If you file a petition for allocation of parental responsibilities both you and mother can stipulate to a parenting plan that involves the children having parenting time with you in your state of residence. If you and mother are not able to agree you will need to ask the court to order the out of state parenting. In any case you need to get your parenting ordered by the court, do not rely on an informal agreement.

Is it legal to omit some property that was left you by someone who passed away, on your divorce papers?: Husbund and I are doing our own divorce through the courts,without a lawyer. My husbund said ,since he hasn't claimed the property that was left him,he didn't think he had to put it on the divorce papers. The property is in another state.

April’s answer: Your financial affidavits should be completely filled out. If your husband owns property you include it. If he doesn't own it then he does not need to list it.

I live in Colorado and the father of the child refused to release the child to me without a notorized letter from me: I want my child back into my custody but the father will not release the child. I called the sherrif department and there is nothing they can do without a court order. A motion for contempt of court was filed but the father has 21 days to respond. the court visitation is every other Friday to Sunday ending at 5:00 PM. How can this be expedited so I can have my child back into my custody.
