I've been charged with larceny of lost property. I returned what I found the same day. Can I get these charges dropped?: On 12\14\14 I was gambling at Remington Park when I found a cell phone on the ground. I asked the nearest people if it was theirs and they said no. I made a stupid decision and left with the phone. I felt bad about it so I called Remington and told them I had found a phone and taken it and I would be returning it shortly. I brought the phone back up there a few hours later and handed it to one of the valet guys. I told him I had found it earlier and please turn it in for me. I thought that was the end of it. Three months later I start getting mail from attorneys because, apparently, I've been charged with felony larceny of lost property even though I returned the phone that same night I took it. Can you get these charges dropped? I don't want to be a felon. Plus, I have a warrant now!!

Carlos’s answer: The police can recommend charges, and usually a District attorney for the state must sign off on the charges before they are filed and a warrant issued. If you have an active warrant you need an attorney, the charges won't magically go away, even if you have a defense. Hire a good attorney that can defend you, and likely keep you from being a felon given these facts.

What normally happens in a non jury trial?: There was two people in the truck first one was male and was pulled out almost immediately and put in a back of a police car the other was a female who was left alone for a good 15-20 min . Upon searching the truck they found meth in one of the two cups in the cup holder . The female claimed the one with lip stick on the straw. The cops found the meth in that cup she is taking it to non jury trial what do you think will happen to them both ?

Carlos’s answer: You waive your fundamental right to a jury of various people to have one person who is learned in the law make a decision of guilt as well as punishment.

Carlos’s answer: Usually in Oklahoma they put the initial charge on the defendant and simutaniously add an ICE hold immigration hold on the inmate. Only after the inmate is bonded on the state or federal charges are they then put into immigration custody.
