Is it possible to ask to serve my time after my baby is born. : My sentence date is April 4. I already took a plea for one year in Wayne county jail. I will be 27 weeks at the time of my sentencing.

Michael’s answer: Ask your lawyer to speak with your probation officer, the prosecutor, and the judge to let each know you will be asking for an adjourned date to report for sentencing. Few jails want the burden and cost of child birth, so I'd think a judge likely would grant the request - especially if the PO, prosecutor, and jail administration concur. Good luck.

Should i let him see her before the court date : I filed custody for my 9 month old daughter, because me and her father seperated. We seperated because he couldnt get off his video game to watch her and i found a wall clinger in her mouth when i came home from work one day. Should i wait until the court date to let him see her? He wants to take her for four days in a house full of kids running around.

Michael’s answer: The law generally looks at this through the child's eyes, and a child has the right to both parents. Since it appears there hasn't been much contact between father and daughter lately, I'd advise you to arrange every other day parenting time pending the custody and parenting time decision. In that way you will show the court you are working in your child's best interest while not unduly burdening your child with a long period of separation from you. Good luck.

Michael’s answer: As father of a 15-year-old you have the right and duty to protect her. Online "dating" with someone who is so much older means trouble brewing. I'd limit her online access and even monitor it. If there is any hint of "sexting" or other sexual matters, alert the police. Although she'll still be a teen needing your support at age 16, believe it or not that's the age of consent in Michigan. That means she could consent to have sex with this creep and the police would have no case against him.
