Am I right to assume this is obviously a scam?: My wife received this email from a "Nathan Chapel" at "Advance America" regarding a loan she never took out. I'm assuming it's to just be ignored, but she's a little shaken up, so I want a second opinion. It reads as follows:
"Re: Notice for payment of outstanding Debt.
Dear Customer,

Our Collection Department has informed us of their intention to file suit as you have failed to answer any of our requests for payment over your past due to the loan account

This is our official notice to you regarding the due payment. You have defaulted to pay the dues - you owe $860.50

You did not make the payment, despite repeated requests from our side.

If we do not receive the payment in full until July 31st, 2024, we will have to do whatever we can under the law to recover our money with accumulated interested from you that includes, but not does limit to legal proceedings against you, not to mention the legal expenses shall also be borne by you.

We are open to discussion till July 31st, 2024, but after this date, we will have no other option, but to go with the legal proceedings.

Thank you.

Legal Department
Advance America."

Can a US citizen living in England sign a durable power of attorney for me to sign documents in Michigan?: I need to transfer a vehicle title from my sister's name into my name. She is a US citizen living in England with no plans to return. The Michigan DMV instructed I need a durable power of attorney to give me the ability to sign the document. My sister will give the power to sign to my sister because I can not sign both the title as the owner and buyer.
How do we write the power of attorney to be used in Michigan?

Timothy’s answer: Simply send the title to your sister to sign and return fed ex. Problem solved without the need for embassies, etc.

If a misdemeanor case is dismissed on motion by the city attorney, do they have to supply and document a reason?: Neighbor got charged with open burning (bon fire) and at pretrial it got dismissed. It took 5 previous visits from the police (warnings) before they were finally charged (6th tine) at our insistence. This is a city environment with 50 foot wide lots. When I look up the case on line it does not say why it was dismissed. We called and spoke with the city attorney who referred us to his assistant prosecutor who handles those matters. He told us he did not know why it was dismissed because it was 2 years ago and there was a different city attorney at the head of the department. Not sure what that has to do with anything….he is acting as if this a 20 year old cold case. This seems so crooked I can’t even believe it.

Timothy’s answer: They have the full authority and discretion to dismiss any criminal case they so choose. The judge may care why they are doing it, but they don’t really intervene either.
