Can I apply for Political Asylum?: Can I apply for Political Asylum by C1 visa, without going on board and changing visa type, and stay legal for the time my case will be at work? And if I have a girfriend, it's possible to get married with her after she come U.S. citizenship. and stop my case?
Divyesh’s answer:
You should only file asylum if you suffered past persecution or fear persecution on the account of race, religion, nationality, membership in a particular social group or political opinion. The persecutor must be government or a group that the government cannot control. Importantly, filling false asylum application, you could be barred forever to obtain immigration benefits in future.
If you marry a United States citizen, you will not be able to adjust status in the US based on your C-1 status. However, you may be able to file waiver and consular process.
More facts are needed in order to be clear what you are trying to attain.
How long is the process if green card holder parent applies for green card of her unmarried son over 21 years of age?: My son is over 21 years old but he is unmarried. I have a green card. How long would it take for him to get a green card after we send an application for him?
Divyesh’s answer:
How long will it take your unmarried son to receive his lawful permanent resident status depends upon his nationality. You would look to the visa bulletin to find your answer. However, you must go ahead and file the petition on behalf of your son so that you can secure a priority date. With that priority date, you will be able to determine when he is eligible for lawful permanent resident status by visiting https://travel.state.gov/content/visas/en/law-a.... You will look to the family-based category under F2B.
Hope the above helps.
