Foster parent have a right to file a TPR?: I have had my foster baby for 6 months, there have been several concerns during these months, and Bio mom has an IQ of 79, and has difficultly reading and writing. There have been several improper feeding issues that have effected the baby, inappropriate clothing ( sleeveless clothing and shorts) in 60 degree weather, diapers being placed on backwards, and the latest concern of all was a recent diaper full of blood coming from the child's private part at a supposed supervised visit with Bio Mom. The doctors cannot confirm if it was a sexual assault, or a very rough wiping. If the supervised visit was being monitored as it should, then how was the diaper placed on backwards ( the person monitoring mom should be watching this)? Either way it is going to be denied by Bio mom and the person supervising the visits, but it can't be confirmed either way, because if the diaper was placed on the wrong way who is to say she did not do something to the baby with no-one looking? This is what is scaring me as my part is to keep this child safe and with no real definite answer, I would hate to place this baby back in the same room with this mother. Any suggestions?

Michael’s answer: Yes, you have the right to file a private TPR, but if the state doesn’t pick up the case, you will be stuck proving the case yourself. You might want to consider hiring an attorney to handle the case for you, or it will not go well.

I just received a notice to appear for a student loan that i failed to fully pay. can i appear without a lawyer? : i took out a student loan in 2005 and i just received a notice to appear for a pretrial conference because i didn't fully pay back the loan. the statement of claim has my name as well as my parent's names.

Michael’s answer: You certainly can, but you might not get the best result. A lot of times, the cost of hiring a lawyer can be offset by the improvement of your situation having a lawyer represent you provides.

What can I do? What are my options?: I just received a summons to appear to a mediation at my county court. I'm being sued by a company known as Cavalry spv I llc for a credit card debt from another company that was opened in 2012 , not them! The original company is Ge retail. I made a last payment on June 2013 but, lost my job. So I couldn't keep up with the payments. As I also had student loans that needed to be payed. I'm lost as to what I should do in this matter? What options do I have?

Michael’s answer: If you have been served with a lawsuit or are about to be served with a lawsuit from a company to which you owe money, do not disregard this lawsuit as you only have 20 days to respond. You have valuable rights which should not be ignored. Hiring a lawyer can also keep you from having to appear in Court for most hearings.
All across Florida, Debt Buyers have overwhelmed consumers. Don’t let the Debt Buying Companies get a judgment against you. They could garnish your wages and bank account. There is a better way. There are several attorneys that concentrate on getting the best possible result against these companies. These lawyers are not hard to find. ;)
