Is it illegal to claim to be a child's legal guardian? : Someone provided my child a bus ticket from Leon to Hillsborough County. I filed a missing person's report. I located them, went to Tampa, and called officers to go with me to pick them up. They told law enforcement they were my child's legal guardian and officers said I would have to prove I was their Mother. I asked what proof this person had to provide and was told that when I had a Wellness check done upon learning my child's whereabouts, the officer noted the call as them being Legal guardian and that was all they needed. I returned with a Birth Certificate and recent court documents showing a 50/50 custody order between their father and I. Officers wouldn't even look at the documents and said that my minor child stated they wanted to remain at this home. After this they withdrew my child from school signing and claiming to be the legal guardian and re-enrolled them into school signing off again as being legal guardian, but not having to provide any documents as proof. Is it a crime to claim and sign as legal guardian? Interfer with the court ordered custody agreement? Can school or police be held accountable?

Michael’s answer: Yes it is a crime to kidnap or interfere with a child custody rights. As stated in the previous comment, you may have a civil claim against these individuals. You may also file a motion for emergency pick-up order in your custody case and if the court grants it you can take a certified copy of the order with you to give police and the police will then assist you in removing the child from the opposing parties' custody.

What rights do people have when a permanent restraining order is against their person?: Do I have the right to be informed of where I cannot go and be updated - exact locations? The person who has a restraining order out against me changed her business and work location from closed to open twice. I could have driven down the road her business was on when back open not knowing the business was not permanently closed anymore.

Michael’s answer: The final judgment of injunction should have all the information you need. If her contact information or business information changes it is her responsibility to file something with the court to update the information so that she can receive her protection. You still need to be mindful of where you are and make sure not to go places that you are not allowed to be. If you see her somewhere turn around and go the other way and leave the area or building you are in to ensure there are no violations.

I need help or advice i was a victim mother ?no one whats help me: AM A MOTHER OF 4 IN WHICH IS THE REASON AM FIGHTING FOR JUSTICE
I called to get help as out of a domestic relationship in which i have been scared cause i was afraid my babies would be tooken on June 5 2019 Early morning maybe 4am the father of my 2smaller boys was sayng that he seen lettering on my body and on my kids he begain argue with me and threatened me.in which he would beat me like I was a man or choke me till I turn purple he always threatened to kill me or beat me or hurt my love one as my family as he would tell me I didn't know his family like that.and with as many beats he did I was scared he put knife my throat even a torch because he would want me to admit to something that was a lie n if I said it was a lie I was calling him a lier and that was not gonna happen so as on the 5th I got the streath to tell him I was done he punched me under my chin which the police report got a picture well as I was trying to leave with all 4 children he got a pair of joggers n put it around his throat n begain choking him self as I told him to stop.he feel I loosen the pants n rushed all 4 children n my self outside as there more just i cant write so muchh on here.

Michael’s answer: You need to immediately contact the police and go to your local courthouse and file for an injunction against domestic violence. Before you go and file the injunction make sure that you print out all your evidence including photos, text messages etc, and bring them with you. If the court grants your request the court can address temporary support and temporary custody. If the children were harmed in any way you can also try and seek an injunction against the father in their name as well.

You may also want to contact harbor house as they have many programs to assist victims of domestic violence and can be very helpful in these situations.
