If the non custodial parent moves out of state first, can the custodial parent then move more than 50 mi without consent?: The father moved to D.C. in 2014. The mother still resides in primary residence in FL (2017). Does the 50 mi relocation radius still apply or can she now move freely? She is looking to move from Gainesville to Sarasota to be closer to family. Does she still need to file a petition with the court to move?

Gregory’s answer: Despite the other party moving first, it would be a good idea to comply with the provisions of the relocation statute. Has the mother contacted the father to see of he will give his consent to such a move? The mother should speak with a family law attorney in her area to discuss her options.

Will I be released from my child support if my ex wife has her boyfriend adopt my grown children? : Divorced for 15 years. Both children are adults and not in school. I owe 23,000 in child support arears. If I consent to my ex wife's boyfriend adopting my children and sign away my parental rights will I be released from support payments?

Gregory’s answer: If there was a current child support obligation, a strep-parent adoption and termination of your parental rights would stop that. However, it would have no effect on an existing child support arrearage.

Can I take my ex back for more child support because he has a job now: When I was divorced in 2010 my ex was told to pay $350 a month for 2 kids. At the time he claimed he was unemployed. Well its been 7 years and he is working full time and I think he should pay more monthly for them, because he doesn't help out with anything else. I pay insurance on them as well.
