Can I deduct the cost of advertising from the heirs that would not sign probate forms?: I am in Georgia and have been told I will need to publish to make heirs aware of a probate even though I know they have received a request to sign off on the probate forms and I have called them to try to get them to help me with this.

Brian’s answer: Expenses associated with administrating the estate can be reimbursed from the monies in the estate. These types of expenses are not technically deducted from the specific heir or beneficiary, they are paid from the estate before distributions are made to heirs or beneficiaries. So in a way their inheritance is less due to the extra costs you have to incur for publication and personally serving the petitions. There is a statutory required hierarchy for the payment of debts and expenses from an Estate. Failure to administer the estate in accordance with all Georgia Laws can result in you being personally liable in some situations. It is in your best interest to consult with an experience probate attorney to ensure you are administering the estate properly.

Brian’s answer: If you are saying that you fell behind on your rent due to this accident, that is not a defense to a claim for failure to pay the rent. So, you could be evicted, however, if you live in this mobile home park where the accident occurred and you have a personal injury claim against them for negligence, then they may be inclined to work something out with you on the back rent.
