My boyfriend was sentenced to 4-9 years he currently in prison and trying to get to boot camp should we hire a attorney ?: My boyfriend was sentenced to 4-9 years for attempt to deliver and tampering with evidence but there was no drugs found the stuff they suspected as drugs came back no drugs they originally charged him with drug deal resulting in death he was found not guilty. Also he was the passenger of the car that was surrounded but because he had a record in middle school with a teacher the judge words he was over sentenced he’s currently trying to get into bootcamp do I need to hire attorney?
Zak’s answer: Boot camp would have to be part of the sentence, so if he was not sentenced with boot camp eligibility, it may be too late. Sometimes it's possible (if it's within 30 days) to file a motion to reconsider the sentence, or to file a PCRA within a year. Both of those options would require an attorney.
Getting a attempted robber house arrest?: My fiancee is in county jail being accused of a crime he did not commit! His bail has been denied and he has been sitting since Oct 9th.. He has breathing problems, dark spot on lung and they keep pushing his prelim out. Now its April 4th 2021 I called his lawyer he never returns call for him or I has never been to visit him. H has contacted nurses for his cheat xrays told them he needs his breathing machine about 4 or more times put request in and they dont check on him. Covid is bad as so is his breathing ismt.he.at higher risk of.death and the man is still innocent till proven. why cant they allow him home and put ankle monitor he gets proper medical attention and I can work everyday and save my home from non payment Cuz of.covid. we really need emergency help his health is being neglected and so is my home. Zak’s answer: Sounds like it may be time to get a new lawyer who will file a motion for a bail reduction.
Can bail be revoked for new charges?: She was arrested for armed robbery, was given 4 felonies (Two-F1, F2, F3) and 3 misdemeanors (M1 and two-M2). Given a unsecured bail of $75,000. Now 14 months later she will be arrested for access device fraud of M1. Will her orginal bail be revoked and have to continue waiting in jail?
Zak’s answer: Bail can be revoked due to new charges but usually is not. The prosecutor would really have to be paying attention and pretty aggressive to file a bail motion on the previous case. More commonly, the pending charges in the old case are taken into account when bail is set on the new case.
