Can a third party be present while exchanging custody?: Birth mother told me if I come in she will call the police on me. She has a third party present and I am there when father picks up. Always. She has a history of false accusations so it's for fathers protection.

Brandon’s answer: Sometimes a third party may be necessary during custody exchanges to help ease exchange. Sometimes it is also beneficial to exchange in a public place to prevent any sort of "false accusations." Of course, it's always best to consult an attorney in your area to discuss the issues surrounding the custody exchanges, remembering that the best interest of the children is truly what matters in these situations. Good luck!

Martial property is in my name only. Can a judge force me to transfer into husband name, so he can refinance?: My husband wants to refinance the mortgage, he wants to have my name removed from mortgage, and have mortgage, solely in his name, before equitable distribution. He claims my name will remain on the deed. However title company asked me to sign off on deed. Mortgage company claims that is not true. I can't afford another lawyer until end of the month. Husband claims if I don't sign, he'll have the judge, order me to sign, can this be done? I'm willing to refinance with both our names, but he is refusing to do so. This makes me leary. Why not refinance with existing mortgage company, and add his name? I feel pressured, and it's making me question his true intentions. My husband lawyer, claims there is nothing my husband could do,to cheat me out of house, but couldn't he add names to deed

Brandon’s answer: It's good you are retaining an attorney at the end of the month. It is questionable why your husband wants to refinance the mortgage and remove your name before equitable distribution is complete rather than enter into an all encompassing Marital Settlement Agreement with you. However, in general, it does not matter how property is titled in Pennsylvania when deciding if it is marital property subject to equitable distribution. Perhaps knowing his motives will be helpful for your new attorney when assessing the situation. Hang in there, and don't let your soon to be ex husband bully you - Good luck!

How do I add name to my sons birth certificate?: My son is being raised by his grandmother do to his moms lack of wanting to participate in raising him. I get him weekends bit want him full time. I can't have him full time because my name isn't on his paperwork, so I can't pit him through school and etc. How can I have my name admitted to the birth certificate and then get rights to my child so that I may take care of him?

Brandon’s answer: Despite your name not being on the birth certificate, you may still be able to file a custody action in the county in which your son lives in order for you to gain more time with your son. Additionally, once you have a court order evidencing you are a parent, most schools will allow you to be involved. It would be best to consult an attorney in your area to discuss your options moving forward. Good luck!
