Owner operator with a LLC business. locked out of business. What kind of attorney do I need?: I am owner operator with a LLC .IN Venice Florida. Have been there since March 2023. I have hired an ex- husband's, grandson. In doing that. The employee (grandson) has taken advantage of me and my business. I am sure his grandfather is taking part in this too. Taking my business accounts changed my login and passwords on my accounts. Ordered metral without my knowledge or concent. Never signed for either. In personanted me with other business's. Taking my bank account money bank from me. Not returning it to me.As I hold the LLC. Has told me that my LLC were reinstated. That were not. ( I trusted these two individuals). With all my heart. Meanwhile the both of them have embezzled money from my business. Stealing Thousands of dollars from my business. Turn the business landlord company against me. Stolen from my business. Changed my locks on my business. Locking me out . While they continue to work out of my business. With all of my business equipment. Everything in my name.

It's unclear from your question whether the LLC still exists and whether the bank accounts, lease, and other assets were in the LLC's name or in your name personally. Your first step should be to clarify who owns what and what the LLC's Operating Agreement dictates. Depending upon those answers you may be able to retrieve your assets and accounts with the help of a business attorney. If not, you probably will need to hire a litigator and file a lawsuit.

LLC transfer or add Shareholder in LLC Texas : I have LLC on My own name in Texas which was created couple of months ago, Now I have investor who wants LLC to be his name or become Shareholder in LLC, Is it possible to transfer LLC to his name or make him shareholder before one year?

James’s answer: You can add your investor as a member of the existing LLC (shareholder is a term for the owners of a corporation, not an LLC), you can change the name of the LLC, you can form a new LLC. The possibilities are many. If the LLC will have the two of you as members, you will want to negotiate a Company Agreement that protects your interests and provides for a smooth operation of the business. You should discuss these issues with an experienced Business Attorney.

Can you make someone a member of a LLC (w/o any say) that works for you? Don't want to make them a employee.: Have a nephew that wants to start working with us in our LLC company but we don't want to make him an employee due to the cost involved. Can we make him a member without any say in the company and still have him do work for us?
