Edit’s answer: Assuming she entered legally you can petition for her as a US citizen spouse and she can adjust her status to a green card holder. This process would take about a year.

Is 1099 employment applicable to STEM OPT student? What can be counted as evidence for 1099 employment?: Can 1099 employment be counted as employment, for STEM OPT student?


In case that USCIS may request for evidence for a 1099 employment, what documents can the STEM OPT student prepare?


What can be counted as "evidence showing the duration of the contract period and the name and address of the contracting company" from the following quote? Employment verification letter, 1099 paystubs, and/or anything else?

Edit’s answer: My understanding is that you must have an employer-employee relationship during STEM OPT- staffing agency and labor-for-hire does not qualify. Volunteer work also does not qualify. You should also speak with your school’s DSO.

How long do I have to wait after divorce to apply for my citizenship? Is there a waiting period?: I have been married since 2008 and got my permanent residency in 2009 through my husband. However, our marriage is coming to an end now and our divorce papers are in the process currently. I would like to apply for my citizenship papers after divorce is complete but I was not sure if there is a waiting period after divorce to file for my citizenship papers or can I file as soon as the judgement is finalized for the divorce? For example, do I need to wait the 90 day period after divorce or not? Thank you!

Edit’s answer: There is no need to wait as long as you meet all requirements. Your divorce has no bearing on the naturalization process at this point.
