What happens if husband is not willing to extend my H4: My husband and I almost went through a divorce and withdrew it at the end moment. My husband has his H1 visa valid until next year and mine has a previous stamping with validity until April 10, 2020. When I asked him to provide me documentation for H4 stamping, he denied. He is not willing to extend my visa while I am here in USA. What can I do in this case?
Ajay’s answer: Although the spouse in H4 status signs the application to extend H4 status, documentary evidence of the principal applicant's maintenance of H1B status is required to be accompany the USCIS application to extend H4 status, such as H1B approval notice and recent pay stubs. Thus, as a practical matter, you do need the support of your spouse to extend H4 status. Similar reasoning is applicable for H4 visa at a U.S. Consulate.
Can my wife work on L2 EAD if go to other country for 6 months assignment: I have L1 visa untill 2020 nov, and my wife is on L2 EAD which expires in 2020 Nov. i may go to Canada for other assignment now for 6 months. Can she work untill Nov in US??
Ajay’s answer: If you are absent from your U.S. employment for such an extended period of time, your wife cannot remain legally in the U.S. in L2 status, let alone be employed because her EAD is derived from her L2 status.
How many days can I stay after h1b ext visa denial?does that count start from day of denial on USCIS site or from received date?: My H1b extension got denied on 03/06/2020 and my I-94 expired on 02/12/2020.
Ajay’s answer: There is no grace period to remain in the U.S. if USCIS denies an H1B extension petition after I-94 has expired. The denial is effective immediately, not when the actual denial notice is received by mail.
