Description: State of Washington appealed a three-part decision granting the Defense's motion to suppress breath test results based on governmental misconduct. Division III court of appeals granted discretionary review on one part of the three part ruling, allowing the remaining two independent grounds for suppression to stand. Court of Appeals reversed on the one ground, and remanded down to superior court for an amended order striking the third prong of the ruling and allowing suppression to be upheld on the remaining grounds.
