  • Bail on a SOC

i have an on going SOC for a DUI, i am wondering when i should be able to get my bail money back?

    Kenneth’s Answer

It depends. If you paid cash bail to the court, it can take a month or so (depending on the court), and it will be returned to the person that posted it. If you posted with a bondsmen then you likely will not get that back. However, if you posted collateral with the bondsmen you should get that back after the bond is exonerated.

  • Lawyer told me this, but unsure if this is the case

I got sentenced to 5 days in jail for dwls3, I report to the jail on a Monday but my lawyer says I'll be out by Thursday? Is this wishful thinking, a good guess or a fact? Thank you

    Kenneth’s Answer

I recently learned that not all of the jails follow the 1/3 off rule. Jefferson county gives 1/5 off unless you are a Trustee (then you get 1/3 off), and Island County only gives you 1/6 off.

Given the amount of information, no one is going to be able to tell you what will happen. You may qualify for the public defender, if not you should start interviewing attorneys in the area.
