I have first-hand, personal experience in matters of probate and non-probate estate settlement, assisted living and long term care placement, financial planning for long term care, and using powers of attorney for financial and health care matters. This has enhanced my ability to help clients navigate the requirements that financial institutions and health care facilities may impose in order to allow a family representative to make decisions or carry out their loved-ones wishes.
After many years of practice, first as a sole practitioner and later as an attorney with a downtown Seattle law firm, I am once again a sole practititioner. My practice is mobile. I meet with clients in their homes or mutually convenient locations, and do not charge for my travel time or mileage. This allows me to get a sense of my clients as members of the community, and it allows clients to relax in a familiar environment while addressing often unfamiliar issues.
In 2001 I added to my repetoire by returning to school and earning a Master of Arts degree in Museum Studies, which has enabled me to consult with and volunteer in various museums and non-profit institutions. When I am not volunteering or assisting clients, I may be skiing, outrigger canoeing, or gardening, depending on the season.

Elder Law encompasses general estate planning as well as Medicaid qualification for long term care needs. I work with families to review facility contracts, to protect assets and to prepare and execute Wills, Trusts, Powers of Attorney, Health Care Directives, Funeral/Cremation instructions, and other appropriate legal documents.

Estate planning encompasses planning for management of your health care decisions and your property during your life, and management and disposition of your assets after your death. It also includes an analysis of your assets to determine tax and beneficiary issues. The usual documentation may include Power of Attorney, Health Care Directive, Will and/or Revocable Living Trust, Community Property Agreement, and Cremation/Interment Instructions.

Estate settlement begins with an analysis of whether probate is necessary, and involves guiding clients through the appropriate probate or non-probate process. I represent Personal Representatives of estates in probate proceedings in King County, WA, and have also served as court-appointed successor Personal Representative for estates in which the Personal Representative resigned or was removed by the court.

Trusts are entities that hold assets to be managed for the benefit of others. I advise clients regarding many types of trusts, including Revocable Living Trusts, trusts for minors, trusts for disabled persons, and trusts for minimizing estate tax.

Every person, regardless of age or wealth, is advised to have a Will to designate who should be responsible for the management and distribution of assets after death. This is a gift you give to your loved ones. Another such gift is a "Living Will", which in Washington is a document expressing your wishes regarding artificial life support if you are in a terminal or unconscious condition. Again, age or wealth do not matter, as accidents can happen to anyone at any time.

You can’t find a lawyer better than Eden Toner. She teaches other lawyers how to handle complicated and simple matters. She carefully listens to her clients and delivers individually crafted solutions. She understands how important these issues are to her clients and their families.
