Description: During a special business meeting, the Board of Trustees were removed from office by a vote from the floor in a highly charged atmosphere. Relations between the Pastor and the Board had become strained and had resulted in this surpise action. Dan filed for Summary Judgment. At the Summary Judgment motion, Dan successfully argued that the Trustees were Board Members under the Washington Nonprofit Corporation Act. Consequently, no Trustee could be removed absent a two-thirds vote in favor of removal. Upon a review of the election results, the two-thirds threshhold had not been met. The court reinstated the Trustees to their former positions.
