I was living in domestic violence transitional housing due to abuse from my children's father and even with me being there the abuse did not stop . In 99% of our conversations he would tell me that I could not see our children unless I had sex wit...
The fact that your ex may have believed his conversation was private will effect the admissibility of any declarations. In fact, this is a situation where the law would have allowed you to record the conversation without his permission. Even though Washington law requires the consent of both parties to record a conversation, there is a specific exception for speech "which convey threats of extortion, blackmail, bodily harm, or other unlawful requests or demands." And, if your ex is a defendant, respondent or party to your lawsuit, then this would generally not be considered hearsay. Good luck.See question
I'm 19 and got a DUI a couple nights ago. I blew a .16 and was arrested, booked, and then the officer let me call my mom for a ride home right after I'd blown the fourth time. I'm not sure if this is accurate though, since I'm a 140 lb female, rem...
Your first appearance is typically what is called arraignment. The judge will confirm your identity, read the charges against you and ask you how you plead. You will plead not guilty. The judge will then impose conditions of release. If this is your first DUI, standard conditions of release will be to not drive without a valid license and insurance, abstain from alcohol or non-prescription drugs, commit no further law violations and not refuse a lawful request for your breath or blood. Depending on your criminal history and the facts of your case, the judge has the discretion to impose conditions like an ignition interlock device on your vehicle, a 24 hour alcohol monitoring device or even bail. Then the judge will set your next court dates which are typically a pre-trial and a trial date. It's helpful to have an attorney with you at arraignment, and there is still time to have one with you. If you can afford to hire an attorney, start making phone calls tomorrow. Plenty of attorneys will return calls and even meet with you over the weekend. You can use Avvo's find a lawyer search tool to locate DUI attorneys in your area.See question

In addition to what Mr. Lawrence said, a judge can also rule a person incompetent to stand trial and deny a trial until that person's competency has been restored or dismiss a charge if competency is not restorable.See question

Taking without permission is the definition of stealing a car in Washington. Previously giving permission to drive your car on one other occasion (or even multiple occasions) does not mean a person has a right to your car. Have you provided a statement to the police? It's really not unusual to see a delay in filing charges, especially in cases involving auto accidents where there is additional investigation and accident reconstruction which needs to occur.See question

For example purposes, I will use apples. If there are no laws stating apples are legal or illegal, in any regard, does that make them legal by default or would it be better to say that are not illegal or legal, they just are.
In that case, I would argue that absent a specific statutory prohibition against the possession of apples, the possession of an apple is legal.See question
Is it illegal for people to use military hand to hand combat tactics on untrained civilians?
There is no specific prohibition regarding the use of military or any tactics in a combat situation other than the general prohibition on any form of assault. Assault of any kind is illegal unless you have a valid legal defense and every situation is fact specific.See question
I got pulled and charge for DUI 2 weeks ago in Tacoma, WA. I have a lawyer and court tomorrow. My BAC is .105. I just really need the truth. What are my chances of this case being dropped down to reckless driving? This is my first charge. Am going...
No one, including your lawyer, can guarantee the outcome of your case. It depends on so many things including the specific facts of your stop, the court in which you are charged and the assigned prosecutor. Since this is your first time, I understand why you are anxious, but you have to accept that your lawyer knows what he or she is doing and let them do their job. When it comes to criminal charges, hope for the best but prepare for the worst. A .10 BAC isn't that high in the grand scheme of things. If your lawyer can get it reduced, great. If not and you are found guilty expect to be sentenced to at least the mandatory day in jail. Is spending one day in jail going to ruin your life or career? Probably not, but it depends what your career is, so discuss this with your attorney. Will you lose your license? Maybe. Your attorney should be conducting a DOL hearing on your behalf, but these are hard to win, so expect your license to be suspended. But even if it is, there are ways you can work around it by installing an ignition interlock in your car and paying for a specialized drivers' license. What will you have to pay? It depends on the outcome of your case, but you've already had to pay for an attorney so you know this isn't going to be cheap. Expect your attorney to tell you to obtain an alcohol evaluation. This will cost a few hundred dollars. Having an ignition interlock costs money and, if convicted, a minimum fine of $940 plus court costs and fees. But again, that's worst case scenario and not necessarily the outcome of your case. For now, just try to relax and don't worry unless your attorney tells you to. And be patient. This case isn't going to get resolved tomorrow. It may take months before you have an outcome and that is completely normal.See question
