I live in Washington state, over a year ago we walked away from our condo with the advice of an attorney that stated HOA cannot sue they will only put a lein on the condo. it is not currently in forclosure and not sure when the bank will take it....
You remain liable for the HOA dues until your name is removed from the title either by a sale or a foreclosure. In the past HOAs were not typically suing over past HOA dues; however, that has changed over the past several years. You would need to look at your HOA by-laws, but most liklely the HOA may still sue you. You may be able to work out a payment plan with the HOA. You may also want to contact a consumer bankrtupcy attorney in your area to discuss your other alternatives.See question
