  • Do I need an immigration lawyer?

My girlfriend who is from the Philippines is coming to the USA on a travel VISA, and we might get married while she is here. If we do, we want to get her neutralization completed, and ensure she can stay here, and begin working in her field.

    Chong’s Answer

What visa is she coming here? Please be advised her intent is very important here. If she is coming here to get married then there is a proper visa for that if she is coming here only to visit then B-2 visa will be perfectly fine. Hiring an immigration attorney is always advisable since you don't want to mess up her green card petition. As my colleague has indicated in order for her to be naturalized, she must first obtain a green card and must wait 3 years after she receives her green card to be naturalized. Good luck.

I got rear ended by kid 16 he fled the scene the police found shortly... the police couldn't find his patents insurance. .. I have full coverage on all my cars except this 1 what would happen if the kids parents don't have insurance my dad has ...

    Chong’s Answer

You need to speak to a personal injury attorney as soon as possible. You say the car that was rear-ended has no full coverage. Please get a hold of your insurance declaration coverage to determine if you have uninsured/underinsured coverage which will help you go through your own insurance for you/your dad's bodily injury claim. Please also determine if you have personal injury protection or medical pay on your declaration page which will pay for the medicals. Have your dad see a medical provider. Also, if you have collision coverage, you can go through your insurance to repair your car.

    Chong’s Answer

Sorry to hear about the misfortune. If you were injured go see a doctor and talk to a car accident and injury attorney. If you were not injured open a property damage claim with your insurance company and be sure to give them the other cars license plate number.

  • After an auto accident, should I sign a "release of all claims" form?

I was rear ended by a semi-truck and clearly not at fault, but the release form states that the claim is "doubtful and disputed" and that they are only settling to avoid litigation. Also that the other party may still come after me for damages. I ...

    Chong’s Answer

I agree with my colleagues, the language used in these releases are pretty standard. What you shouldn't do is sign it without consulting with an accident and injury attorney. Most will offer free initial consultation. Hope this helps and best of luck moving forward.

  • I have sent a demand letter to an insurance company; they would like to speak to me regarding some "details". Is this advisable?

My family was in an auto accident 2.5 years ago. The insurance company sent me a settlement letter roughly 6 months ago. I sent my response in the form of a demand letter just last week. I received a call from the insurance company saying they wo...

    Chong’s Answer

I wouldn't advise speaking to the insurance company without making sure you have everything you need to answer their questions. If the facts differ, adjusters will not let that go unnoticed. Please be advised that the time limit to resolve your claim is 3 years from the date of the accident if you haven't resolved it within the 3 year time limit. You will be out of luck. I agree with Mr. Rounds if you wait too long, many PI attorneys will be reluctant to take your case. You should consult with a PI attorney for a free consult before doing anything further.

  • I was injured in an auto accident, the drivers license was suspended and he did not have insurance. He was at fault and sited.

Can I sue for this and how? I had a broken sternum in 3 places, 8 fractured ribs, and several vertebrae fractured. I had a large hole on my chin and a large hematoma on the same shin. The person who hit us was sited and at fault and he is also...

    Chong’s Answer

In order to go through his employer, you will need to determine whether the accident occurred while he was working at the time of the accident. If not, I agree with my colleagues, if you have uninsured motorist coverage on your vehicle, you will need to go through your own insurance with this claim. It might not hurt to call or sit down with a personal injury attorney for an initial free consultation.

  • I was hit in an unsigned intersection on my rear bumper. Hit so far back on my car, is 50-50 what I should hope for?

Intersection was 4 way, no signs. Person who hit me was on my right but I was 98% thru the intersection before she looked up from her phone and then ran into my rear R side bumper.

    Chong’s Answer

From your facts, I agree with my colleagues, theother driver more than likely will be more than 50% at fault. If you were injured, you should seek help from an atttorney. If you weren't injured, contact your insurance company and let them handle this matter. Good luck!
