  • Once appointed can an administrator to an estate sell a house?

Once probate is filed can an administrator sell property? The property had a reverse mortgage and to sell it would be the only way to avoid foreclosure. However there is not sufficient time to wait for the whole probate process.

    Raphael’s Answer

The process depends on the type of powers you have under the will, but yes, you generally can with court supervision. You have to be careful with reverse mortgages. Talk to an attorney.

  • Can employers advertise raises for higher performance if they do not intend to honor these raises when minimum wage increases?

I started working for my employer at a minimum wage position in 2013. In 2015, I was promoted to a position with greater responsibilities, which increased my hourly wage to one dollar above minimum wage. Then in 2016, minimum wage in California in...

    Raphael’s Answer

That would be legal. Your employer is not required to increase your wage, although I understand the unfairness that you feel.

  • I am concerned this will end up being a total loss situation. will i have to pay 33% even if nothing has been done yet.

I was involved in an automobile accident december 8th which was a roll over accident with me and my daughter. bills are already at over 20,000 for my daughter and around 15,000 for me. I hired an attorney 10 days ago, but after getting my bills ...

    Raphael’s Answer

Sorry to hear about the accident, and I hope health wise you all are ok.
If you want to terminate your attorney, call and discuss with them. It will largely depend on how the agreement was written, and what services have already been provided. However, the issues are usually more complex than they appear, and a good Personal Injury attorney can generally provide you with better options and better recovery than you could on your own. Good luck.

  • Can a US corporation get (or does it need) a VAT number to operate internationally?

We are a nonprofit corporation (501c3) registered in California. We have international board members, and we intend to operate some programs outside the US. Most would be short term, such as helping a rural community recover after natural disaster...

    Raphael’s Answer

It really depends where you will be providing services, what those services are, and whether your presence overseas is such to trigger the requirement of registration. Merely doing a "small" program will not likely trigger it. Actually operating overseas and having a subsidiary or branch there, can trigger it. You should consult with a local transactional attorney who understands the international arena. Good luck.

  • We are receiving money from oklahoma from oil wells. How much money should we save for taxes. We live in California.

We have property in Oklahoma. They are drilling for oil. We get royality checks monthly. How much do we save for taxes? We live in California. We received roughly $22,000.00. Is there a percentage we should save for Uncle Sam? And can we use that ...

    Raphael’s Answer

It depends on lots of factors, including whether the oil wells are being depreciated and if you can claim such depreciation, your overall income (since income tax is based on a graduated system), and what taxes are taken out before you get your royalty check (since there usually severance taxes taken out of every check). There can also be local/property taxes taken out year end. Depletion and production taxes can usually be written off on your federal income tax return. Bottom line is usually to find a good local CPA who understands this stuff, and wait a year before you touch much of anything, so you get a cycle of income/tax and have more knowledge about what to expect. Good luck.

What you describe sounds illegal. I would talk to the manager at the bank, to figure out what happened. And unless I got a really good answer, I would probably change banks. Good luck.
