Jimenez v. Holder

Case Conclusion Date: 05.06.2010

Practice Area: Immigration

Outcome: Petition for review granted in part.

Description: I presented oral arguments before the Ninth Circuit in a case involving a mother and two daughters who had been denied non-LPR cancellation of removal for lack of sufficient hardship to their lawfully present family members. The issue before the Court was the jurisdictional bar to its review of discretionary judgments. The Court found that, as to the daughters, the agency had applied the incorrect legal standard and it therefore granted the petition as to them, in a memorandum opinion.
