First he was referred to me by a close friend and the moment I met him, I knew he was the right attorney to work with, by the way he listened and gave feedback. For once I've selected a highly intelligent individual that knew all his material. Who in their time has the ability to gain an engineering degree, a real estate license, law degree in the U.S and Europe, teach law and to continue advancing his fields by attending night school? Some years ago, I created websites for friends and acquaintances' small businesses. I hired a help from a graphic artist who was a stay-home mom then.
Everything was fine until recently when these business owners started receiving certified letters via overnight express from big time companies accusing them of copyright infringements and demanding exorbitant amount of money.
My graphic artist probably made an honest mistake.
I had no problem paying for copyright infringement, but the amount they were demanding was ridiculous, and these guys were hard-nosed and did not want to negotiate!
For a small image which would cost $5 on their websites, these companies were demanding thousands times more per image for infringement, or face the lawsuit.
Besides the tough economy, the looming lawsuit and the scare of hefty demand were making the situation really tough for me and the small business owners.
I have never been in legal trouble before, so not knowing where to turn, I googled for legal help, and found Bay Area Legal Aid, which referred me to Stuart West.
In retrospect, that was the day the reversal started.
When I met him in his office for the first time, Stuart's appearance was not the lawyer fitting the usual stereotype I see in movies - he was in T-shirts, I think. Causal, informal, and approachable.
Not too long into our talk, I began to sense he was genuinely interested in helping me.
He was not looking at his watch, was not trying to gracefully end the session for his next client, but was trying to help me understand the legal aspects of what is entailed, what legal defense strategies he is going to take, and possible resolution, cost, duration, etc.
What scheduled to be 1 hour session went beyond, during which he googled together many sites to show me and research and explain.
I forgot all about what should be an intimidating experience in lawyerâ€™s office with a patent lawyer whom I had never met before.
The session was a pleasure, informative, and reassuring.
Since Stuart took up the case, the companies scare tactic all went awry.
He keeps me updated on situations and progress, and forwards me email communications to keep me informed. His office's billing rate and details are reasonable and transparent.
Today, the case is still pending resolution. However, Stuart's expertise and professionalism already saved me from grief. I am confident that the case will be resolved in a fair, favorable way.
