VERY sorry to hear this. It's hard to prove a negative, ie, "they never sent" as all they need to do is "pretend" or "make up" such a notice. Maybe you have some writings from prior to the sale that can show what happened?

To date, I'm fairly certain no case has ever decided the issue in CA. In many other states, that money is either specifically included or excluded. When it's decided, it's likely to go against consumers. There are other ways to get more money, regardless of what you call it, but, if you are doing this without the help of an attorney, you've made a poor decision in the first place, since attorneys are paid (in this area of law) by the other side (Nissan here) and typically get you the best results:
