Interesting question. If you divorce in CA courts, it will take at least 6 months and 1 day, from date of service. CA courts will have jurisdiction to divorce you. You need to either discuss it with consulate directly, or find an attorney that has experience with that kind of dissolution, provided it is indeed available in your situation.

Well, I would assume there is an ongoing divorce proceeding taking place. Also, a question - your own payment plan - is it a written agreement? (I would hope so) - because absent such an agreement or a court order it will be that much more difficult to try and get the Father to pay.

In CA, for example, the amount of child support, depends, among other things, on parent’s earnings and the time each parent spends with a child. An attorney practicing in your state would be the best person to turn to in this situation. It is also not very clear whether you are going to court as part of the divorce/legal separation proceedings. At least do not ignore it. Without knowing much detail of your case, it is difficult to help you. However, one thing you should do is to file an answer to the complaint and you can also file a motion to change venue so that the case would be moved to the place of your residence. Unless the other party has a reason to sue you in another state, you should be able to win on this motion.
Another recommendation is to check with your local Legal Aid services. You might qualify for some kind of free legal advice in case you cannot afford to hire an attorney. But I would definitely recommend contacting one.
