    My client previously negotiated a moveaway and moved out of state with his minor children. Mother requested the court order a moveback citing issues with the "Contract" agreement for the moveaway, and asked the court to dismiss the case on a contract basis. We demonstrated to the Court that there had been no change in circumstances that would be needed to consider any change in custody. My client maintained custody and was put in a more favorable financial position regarding costs for visitation.

    Description:
    Parties admirably settled their dissolution on their own. Without seeing an attorney, they hired a document service to write up the marital settlement agreement (MSA) which became the judgment. After the judgment was entered and the house was set to be sold per terms of the judgement, the other party "remembered" that he made the downpayment on the house with separate property money. This was NOT provided for in the MSA, but he insisted he would prevent Petitioner from getting the money from the sale of the house. Petitioner hired me to review the documents and then to acquire the monies per the terms of the contract. In less than two days this was accomplished. Petitioner got the settlement for which she bargained. LESSON LEARNED: ALWAYS HIRE A LAWYER AT LEAST TO REVIEW PAPERWORK THAT WILL IMPACT YOUR LIFE SIGNIFICANTLY.

    Plaintiff obtained a Civil Harassment Restraining Order. Statements Plaintiff made were vague and general. Through testimony and cross examination we were able to show that the charges leveled against Defendant were unfounded and didn't meet the burden of proof in this case. The restraining order was denied.
