    I've seen this before many times. Bottom line - he will have a choice to make. Do what DMV wants (DUI classes here in CA) or he can do a Writ of Mandate to force DMV to give him the license. Most attorneys don't do DMV writs, so you need to seek one that does. it can be expensive as well.

    my blood result from the DUI came back at .16 and I had 6 glasses of wine between 9:30pm - 1am, but my blood was not drawn until 6am. I tried to look at it with a BAC calculator and all results i got shows under .05. Could there have been an error?

    Yes, the sample could be compromised. You can have it retested as well as tested for sufficient anticoagulant and preservative. Hire a dui lawyer!

    All the other attorneys are correct, but I am surprised none of them mentioned that you can challenge the DMV decision. You have a very limited time to do so. Talk to your attorney. If he/she doesn't know about DMV Writs, call one of these very qualified attorneys here on AVVO.

    Ken Hamilton has a point. To be certain of your options, we need more info. What was the date of arrest? Did you have an APS hearing with the DMV? Did you have a departmental review? Was the case dismissed or never filed? If dismissed, was it by the prosecution motion or defense motion? All of these can effect the deadline to fight DMV and also what chances you have to prevail. You need an attorney that does DMV Writs on a regular basis so they are familiar with these things. Call one and get a free consultation before it's too late.

  • DUI's in NJ are not considered misdemeanors, but what will the state of California classify them as?

    Will the offenses for the DUI's I received in NJ be re-classified and show up as misdemeanors in CA? Or will CA keep their status as only traffic offenses?

    If you got a DUI in CA, the court will likely use NJ convictions as prior offenses to increase your punishment. A good DUI lawyer will know how to defend against that. Also, even without getting a DUI in CA, the CA DMV will likely find out about the NJ convictions when you get (or renew) a CA license. There is also a way to have the NJ convictions removed from your CA license record. If this is happening to you, call a DUI attorney and setup a consultation immediately.

    I agree with my colleagues. I would add that you can also predict WHEN the suspension will take place. Look at your expiration date on your California license. When it is time for you to renew, bingo. To avoid the suspension and points increasing your rates, you need a lawyer here in CA to do a writ of mandate.     It sounds like he has 3 DUI convictions and this new case is just driving on a suspended license. If that is correct, then he could be INITIALLY looking at as little as 10 days custody (which he may be allowed to serve as cal-trans, community service, or other alternative). But he could have probation violations on each of the DUI's which could mean more custody time. If he has prior arrests for driving on a suspended license, he could be facing a minumum of 30 days custody. There are a lot of variables here. He should talk to a DUI attorney immediately.

    You are entitled to a restricted license if you are enrolled and have the IID installed. If you get different answers than that - they are wrong.
