Was the case dismissed or never filed? If dismissed, was it by the prosecution motion or defense motion? All of these can effect the deadline to fight DMV and also what chances you have to prevail. If you got a DUI in CA, the court will likely use NJ convictions as prior offenses to increase your punishment. A good DUI lawyer will know how to defend against that. It sounds like he has 3 DUI convictions and this new case is just driving on a suspended license. If that is correct, then he could be INITIALLY looking at as little as 10 days custody (which he may be allowed to serve as cal-trans, community service, or other alternative). But he could have probation violations on each of the DUI's which could mean more custody time. If he has prior arrests for driving on a suspended license, he could be facing a minumum of 30 days custody. There are a lot of variables here.
