It depends in a lot more facts than provided. If your case is denied they do not have to pay you until it is admitted or tried. If you are seeing a mutual doctor and that is an AME. The AME should state the periods of disability. However you will not double recover for the periods that SD paid however your funds should be replenished by defense if so. You should get an attorney if you do not have one. If you got injured due to unsafe environment when they knew it was unsafe you will have a Serious and Willful claim against them on top of the employer. The doctor is doing his job. You might feel fine but that does not mean that some type of activity might not aggravate or affect your progress due to surgery. If you called Larry H. Parker it is very likely that your friend's attorney is Perona Langer. As to the case it can settle with him behind bars however to amount depends in lots of circumstances. Was he P&S? MRIs? Etc... Attorney can delay case if time incarcerated is less than a year and there is less than one year inactivity. However I highly doubt that a judge will dismiss claim when attorney notifies judge that applicant is incarcerated.
