The fine maybhave only been $50, but did you pay just that amount or did you pay around $200? There are penalty assessments on top of the base fine. If all you paid was $50, you didn't pay it all off.
You're going to have to go back to court.See question
my sister was recently arrested in santa ana OC , CA. for child endangerment charge , that her daughter went to the police and pressed charges against her Father, why would they take the mother in , that she just got home from work. she has been...
I'm assuming they continued her arraignment since her next court date is another couple of weeks out.
There is much more to this story for the bail to be set as it is. Her lawyer is going to have to review everything.
In the mean time, do NOT DISCUSS THIS WITH HER. Any visit or phone call can be recorded.
You need a good criminal defense attorney. I'd strongly suggest you find someone who focuses on criminal law and who routinely practices in the court where this case will be heard.See question
Got in line to pay at Costco was in line with my mom and had to use the restroom. I asked mom to wait in line and had two people ahead of us. Have her my membership card and by the time I was almost at the restroom the LP came behind me and said I...
While normally they wait until someone leaves the store, they could (and apparently did) arrest you even while still in the store.
Your lawyer (yes, you absolutely need one) will review the witness statements and any surveillance footage in your defense.
You need a good criminal defense attorney. I'd strongly suggest you find someone who focuses on criminal law and who routinely practices in the court where this case will be heard. You should always have an attorney. If you truly cannot afford one (and you'll never know if you can or not unless you meet to discuss your case, fees and payment options), you can request that a public defender be appointed.See question
They were trying to charge me with a Felony. I decided to go to trial after 20+ months of wasting time going to court. They just offered me a deferred entry of judgment with 2 misdemeanors, one for speeding and one for evading the CHP and a speed...
There is no way that I or any other attorney on this website can't advise you what you should do with your case. Only your attorney (the one who actually represents you and has access to all the information) can do that.
In your discussion with them about what to do, make sure you understand that you are facing a felony charge that carries a very real potential of significant jail time. Instead, you are being offered a diversion resolution were the case would be dismissed as long as you did what was asked of you in the deal.
not a bad outcome.... facing a felony and now have the chance to get all charges dismissed....
Worth considering - and discussing with your lawyer.See question
I have not got in any trouble since then. I got of parole for good behavior. Since then I went college found a job in the medical field. I've been the the company for 8 years. I would like to find a better company to work for and feel trapped wher...
Because you mentioned parole, I am assuming you went to prison. If that is the case, your only true avenue to pursue is a certificate of rehabilitation and an application for a pardon from the governor. You must demonstrate that you truly have been reformed. You must demonstrate to the court that you have reformed and have remained crime free since this incident years ago.
If your certificate of rehabilitation is granted, that becomes your application for pardon from the governor. Assuming this did not involve the personal use of a firearm, you may be granted a pardon. It certainly is not automatic nor will it be easy.
I would suggest consulting with an attorney now to prepare yourself for the documentation and evidence required to demonstrate your rehabilitation. You may not be in a position to file just yet, but you can start doing the groundwork now.See question
Looking to set up a store front in Richmond ca for a medical marijuana dispensary
While the election results have changed things with regard to marijuana, the regulations on how when and where within a city they will be allowed and regulated is still in process.
Your question goes way, way, way beyond a simple online question and answer. Given the amount of regulation that is going to be involved in an approved sales location, you will need to have an attorney on retainer to advise you and guide you through the process to make sure you were doing this correctly. This isn't a matter of filling out a form and opening shop. This is going to be a convoluted and highly competitive field. Get your money together and hire an attorney.See question
What are ways to guarantee safely and legally leaving? And are there any reasons you couldn't leave the house at 19? (previous records, etc)
Legally speaking, you're an adult at 18 so you can move out any time. I hope you have a plan on how you're going to support yourself once you leave.See question
I just shoved my girlfriend with my shoulder to get off the street. ... She wants the charges to be dropped
There is no such thing as a "first offense dismissal" rule. Could the charges be dismissed? Absolutely. Could the prosecutor decide to proceed on them even if she didn't want to charges pressed? Absolutely. The question becomes whether or not they can prove the case without her cooperation and testimony.
Trying to make anything happened to this case will not be a project that you can or should attempt to tackle on your own. I assume from the questions that you have already been charging cord. It's time to get an attorney.See question
I am asking on behalf of a friend who has reason to believe that a search warrant may be issued to search his home.
No, you have no right to have your attorney present during the execution of a search warrant. I assume when you say "issued" you mean when the police come out to actually do the search itself.
When a warrant is issued, it's actually done by the police directly with the judge. No defense attorneys are present - it defeats the purpose of the element of surprise in finding what is being sought with the warrant.
And just to round out your question, if you were able to hire an attorney and have them sitting at the house 24/7 waiting for the warrant to be served (executed), they couldn't do a darn thing except get themselves detained pending the determination of their connection to the property being searched. They cannot stop the search or dictate anything. The time to fight a warrant is in court after it's all done, not with your lawyer standing there at the front door trying to control things.See question
