I know of a case where a parent adopted her own biological children. You would need to be able to show some major changes since rights were terminated and have a court willing to do something very unusual. Feel free to contact my office for a consult.See question
I have supervised visits with my son on my days off can CPS overrule the Family Court decision and take all visitation away
The juvenile court will make an independent determination In the best interest of the children. Visitation is generally ordered unless visits pose some detriment to the children. A good dependency lawyer can analyze your specific situation.See question

What if it cant be turned into a misdemenor?
You can ask for dismissal via 1203.4 for a felony, but I always suggest attempting to have the charge reduced to a misdemeanor first, if the charged is a "wobbler" (can be reduced). Otherwise, a felony can be "expunged" via 1203.4. However, some crimes may still count as prior convictions if you commit the same crime in the future. For example, if the crime dismissed via 1203.4 is a DUI, a subsequent DUI is still charged and adjudicated as a second DUI. I handled 1203.4 motions regularly in my practice and offer a free consultation if you have additional questions.See question
shouldnt cps back off when the hospital rules out child abuse? and can a hospital withhold that same information?
CPS can do a lot of things. It really depends on the facts of your case. CPS can place a hold for additional tests or another opinion to be rendered. You should contact a CPS attorney in your area. If you contact my office, I can give you a referral.See question

You should appear at every court hearing you are advised of or the court can issue a warrant for your arrest. You can hire an attorney, the court will deal with you and your parents in pro per, or you can request an attorney be appointed. If you have a witness for you, it is important to provide that information to any attorney assisting you. The court can proceed with the charge regardless of whether the officer shows up at your arraignment because a trial date in the future is usually set and that is when the cop has to show up.See question

What a nightmare. The child's attorney certainly should be responsive and you might contact the supervisor. Your alternative is to contact CPS. You can call the anonymous tip line or identify yourself. Either way, it is not acceptable for an adult to drive with a minor child in the car after drinking, regardless of whether the child felt she was intoxicated. How ridiculous! You also did not mention your relationship to this child. If you are seeking custody, you might contact my office to see if I can assist you in any way.See question
