Description: Class action complaint against attorney Peter Recchia and his company, Fair Credit Lawyers for violating the Credit Repair Organizations Act (CROA). District Court certified the class action then held Defendant violated CROA, because he accepted advance payments from Plaintiff and did not provide contract and other disclosures required by CROA. The U.S. Ninth Circuit Court of Appeals affirmed judgment and class action settlement on May 27, 2010. The Ninth Circuit said that attorneys are not exempt from CROA and Mr. Recchia's advertisements to improve credit scores and correct errors made him a credit repair organization, which must comply with CROA.
