    Are you still on probation on the first Dui?
    Custody time is mandatory by law with a prior. There is alternatives that sometimes can be used as an alternative. The key is to be proactive and begin your defense as soon as possible. I recommend contacting attorneys here on Avvo.

    Mr Finnecy is spot on. I would recommend contacting the Nevada DMV.
    If it is at all possible to complete the course here do so. Most of the programs allow for a leave of absence.

    The prosecution can and does prosecute some cases that have a BAC under .08%. You should contact a local attorney here on Avvo and get the evidence.

    You have 10 days to set an APS hearing. In a perfect world you would have an attorney handling this for you. Your first step is to contact an attorney on Avvo. Your first hurdle is to try to obtain a set aside on the DMV side then avoid a DUI on the court side.

    VC 14601.2 is one of the tougher license suspension charges out there. It comes with 10 days custody and IID.
    You need to contact an attorney here on Avvo if you can to assist you.
    You are also on probation and have a good chance to be violated (especially if your DUI is out of the same courthouse).

    From the information you gave it appears the most likely scenario is non compliance with probation/violation.

    You cannot be sure though without looking into it. You may want to consider obtaining counsel to represent you on this issue.

    More facts are needed to be fully accurate. What it sounds like is your "friend" was arrested and booked on charges. The prosecution reviewed the facts and issued the charges on the complaint at arraignment. What the officer initially arrests does not always make it on a complaint. The prosecution can review the evidence and see additional charges. The best thing to do is to review this with your attorney.
