If the harassment is based upon a protected characteristic -- gender, race, sexual orientation, for example -- you might have a claim under the Fair Employment and Housing Act. If the harasser is a co-worker, as opposed to a supervisor with authority to terminate your employment, your employer must have notice of the harassment before it can be held liable. So, I always tell my clients: "do not assume everyone in the company is a bad guy." Report the conduct, preferably in writing so you have evidence, to someone with authority to act. By law, your employer has an obligation to take all complaints seriously and conduct a reasonable investigation. Good luck with your matter.See question
