I consulted w Jay about possibly being arrested for not complying with a subpoena to testify in a matter where I was the victim. He told me six times that I " should go". He asserted that my daughter and I ( I am moving toHawaii) should " move out of state" if we want to be safe.
Obviously he was once a deputy district attorney. He refused to offer any advice upon what to do if I was arrested. I am not testifying due to threats. That have been previously, and no doubt will be carried out as threatened. His advice was to do whatever they ( district attorney's office ) wants.
My question, was, (I never even got to ask, as he interrupts, raises his voice and didn't allow me to speak) if I am arrested is there an affirmative defense, because I didn't want the physical threat carried out that the defendant promised to do. I've been through ligament reconstruction surgery, house set on fire, animals taken, animals now dead... and I wanted to inquire about Marsy's law in CA about not putting victims in jail .
He was rude, condescending, didn't listen to one word I said, and was a complete waste of Money and time.
