About me

David Hoffman has practiced patent, trademark and copyright law exclusively since 1985. He has a B.S. from MIT and law degree from University of Pennsylvania. Mr. Hoffman represents all size businesses with a sweet spot of software companies and manufactures doing $3 to $50 million in annual sales. By both litigating and procuring rights for his clients, he understands how to avoid litigation and how to resolve it quickly. By obtaining broad rights, performing good clearance procedures, and negotiating, he has successfully helped his clients steer clear of litigation and minimize the impact of litigation. Mr. Hoffman has taught for a patent bar review class, authored articles and given lectures on intellectual property.

Mr. Hoffman has experience in all phases of IP practice: licensing of inventions, counseling and obtaining IP protection in many technologies, e.g., computer software, business and internet processes, smart phone apps mechanical, electrical, electromechanical, microprocessor control, medical, optics and materials science, as well as litigation. He has also performed numerous patentability, validity and infringement studies and due diligence and clearance projects.

Areas of emphasis:

Developing a sensible cost effective intellectual property plan that considers and meets your business goals so you still have money left over for marketing and manufacturing

Infringement clearance and design around studies to avoid being sued for infringement

Resolving thorny and complex issues with the patent and trademark office so you can get a patent or trademark and move forward with your business

Defending you against trademark, patent and copyright infringement claims and appeals, and helping you move to a better noninfringing position and ending the money drain, and where possible, using Post Grant Review, Covered Business Method and/or Inter Partes Review or Reexamination to avoid patent infringement
