This case involved, at first, devastating paraplegic injuries to Maxine Warren suffered in a tragic 3-wheel All-Terrain Vehicle (ATV) accident in Utah. Tragically, Maxine succumbed to those injuries (by taking her life) when the physical, emotional and psychological pain was too much to overcome. The defendant, Honda Motor Company attempted to have the case dismissed on the claim that it was "not subject to the Court's jurisdictional" in Utah and that it was a "Nonresident Corporate Defendant." In this significant published opinion, the Court held the defendant to Answer to the Causes of Action filed against it in U.S. District Court. The defendant ultimately came to the settlement table and the case was resolved to the satisfaction of all parties involved.
