    I was hit from behind in a hit and run which caused me to swerve into the curb and wreck my car. Police did a field sobriety test on me and breathalyzer. I blew a .08 and was not arrested. The suspect was never caught.

    It could come up and you should tell the truth, but from what you have indicated it does not appear you share any liability for the accident itself. Consult with a personal injury lawyer asap to determine if you have a claim for uninsured motorist benefits under your automobile coverage.

    First of all, sorry for your loss. Based upon what you have posted, the living sister would be the heir, assuming there are no surviving parents or a will specifying otherwise.
