Little Contact-Motions Filed Without Consent

Little to no contact with us, explained nothing unless specifically requested, filed a continuous without our knowledge or consent, and then when we filed to have him removed from our counsel, after 5+ months of inadequate service, it was denied because the judge didn't want the case to be continued ...again to let another lawyer review the case, even though Mr. Durham admitted to the judge that he had not reviewed our case at all. He had no help in his office besides a receptionist, so he doesn't have to do his job unless it benefits him. The entire time our case was in the preliminary phase he assured us it would never go to trial, then, magically his tone changed to it's going to go to trial but I think I can win it. I feel like he's a pawn in the DA's pocket!

Honest, Respected, Hard Working!

I did not hire Ben Durham, Ben was appointed to my case at my arraignment. My charges were Count 1. Conspiracy to violate uniform controlled substances act. Count 2. Trafficking in Controlled Substance. I explained to Ben I was in the wrong place at the wrong time. I knew my friends were Drug Deale...rs and i also knew I wasn't a saint.. They lost contact with each other and my friend called me and asked me to fly down from Seattle to help find his partner. Within 4 hours of arriving we were arrested. I knew because of a prior Felony conviction I might be looking at some time. Ben started immediately counseling me with his thoughts on what I should do. He assured me he would do everything in his power to avoid prison time. I was released on my own PR and flew home to Seattle and immediately reported to Probation. I did everything they asked, a couple UA's per month starting out, along with enrolling in a 1 year Intensive Outpatient Drug Treatment Program. I also started going to 4 AA meetings per week and had my court slipped signed to provide to Ben, Probation and my Judge. I knew in my mind that if I was going to get any kind of a DEAL I had to prove myself. I received my Pre-Sentence Investigation Report from Probation and they were asking for 97 months In-Custody and 3 years Probation. WOW! Ben suggested I get some letters from friends and family to provide to the Judge. He said the decision is up to the Judge! I immediately started asking everyone for a Reference letter. Ben said you have a lot of letters, I think i had 40 letters from family, friends, friends in AA (alcoholics anonymous) and my Doctor. I was so nervous at my sentencing almost 2 years form the date I was arrested. Ben was so calm, cool and collected. He spoke on my behalf about all the work I was doing to change my life. I really was so blessed to have Ben representing me! When the Honorable Judge Gordon read the 58 pages of the Sentencing Memorandom that Mr Benjamin Durham prepared I knew I was represented with the Best Counsel in Las Vegas! I was given a huge deal. 3 years supervised probation, a $200. fine and 100 hours of Community Service. Judge Gordon read every page submitted to him and could sense from all the letters that I was serious about changing my life and instead of wasting away in Prison I could more benefit my community by being of service and helping those still struggling with addiction. I am happy to say that I am compliant with my Conditions of Release, Ive completed my 100 hours and paid my fine. I am the GSR (general service representative) of my AA Homegrown and also the Public Information Rep for my District here in Washington. I don't know what my life would look like currently if I didn't have Ben Durham in my corner over 2 years ago when I was arrested. I have the utmost respect for Ben and he is welcome in my home anytime he comes to Seattle. I witnessed 2 miracles within a couple weeks! The first 1 was the Seattle Seahawks beating the Green Bay Packers in the final minutes to win the NFC Championship only to lose the SuperBowl to New England in the final minute! But the second miracle was at my sentencing. All my prayers and hard work is starting to pay off. All Praise, Glory and Honor goes to God! I am ever so humble! In closing, if your back is against the wall and you need Counsel, I recommend Benjamin Durham and his Staff. They will work hard on your behalf. I guarantee it! Thanks again Ben, your the best!

Revoked Probation

Mr. Durham was the best thing that could have happened to me. I was on probation for a prior offense, 4 years in on a 5 year probation my officer tried to violate my probation as I was not working and could not pay the fines. I was facing 14-48 months in NDOC. He answered every question I had. When ...the 1st date neared the told me he was going to ask for an extension to review the case. I had to sit in CCDC for 30 days I was sad and scared about this but when my 2nd court date (revocation hearing) came I knew I was in good hands. My judge was Valarie Adair and with my probation officer there stating false accusations Mr. Durham stood up for me. He responded to the Probation officer and brought attention to the judge of all the good things I had done during my time. He was able to give me a "Dishonorable Discharge" from probation. *This occurred because I could not pay the probation fees, if not it would have been an Honorable discharge. For the 1st time in 4yrs I was able to walk out a free man, with no fear of going to prison or meeting a curfew. Best Lawyer in Vegas!
