  • How much is a criminal layer going to cost and are there payment arrangements?

    I just got a felony and a mistiminer last Thursday, I believe it's a class 4 child abuse and something to do with "contributing to a minnor " not exactly sure. I am currently on probation and I need these charges dropped. What's my best option

    If your probation officer has not filed a Complaint to Revoke your probation yet he or she will be soon based upon the alleged new law violations. If you cannot get the charges dismissed on the new case you are looking at being resentenced on the charge you are on probation for. Most attorneys in the area will offer a free consultation and then quote you a fee. Some attorneys will offer payment plans. If you cannot afford a private attorney you can apply for assistance with the public defender.

    Never just "take" a DUI. You need to hire the best attorney you can afford. An experienced attorney can spot and exploit mistakes made by law enforcement and assist you with reducing the consequences of the charges as well as any driver's license ramifications.

    I wold recommend you meet with a lawyer right away to discuss the case and your options. You will not be able to resolve the case in any way with the warrant outstanding. A lawyer can assist you with the bond process and ultimately defend you in the action.

  • Do I have to appear in court? What happens with my offense, since Arizona is not a state that lists careless driving as an offen

    I am an Arizona resident cited for careless driving in Colorado after rear-ending a car in front of me due to a sudden stop. At the time of my court date in Colorado, I will no longer be in Colorado, but my ticket says I am mandated in court.

    If you received the ticket and are summoned to appear in Fort Collins you will not need to show up for court if you have an attorney.

    It sounds to me like your license was revoked due to the DUI. If so, you are likely charged with Driving Under Restraint due to a prior alcohol offense under Colorado Revised Statute 42-2-128(1)(d). If convicted of this charge you are facing a mandatory minimum of at least 30 days in jail as well as further DMV consequences. I would recommend contacting an attorney to discuss the case as well as your license status.

    Only the district attorney can drop the charge at this time and it is very unlikely that they are going to do so even if your husband wants the charges dropped. They receive letters and motions from alleged victims in many cases and they almost never act on them. I would recommend you meet with an attorney to discuss your options and if you can't afford an attorney you should apply for assistance with the public defender's office.

    I spoke to the owners of the property, apologized, and they are fine with dropping the charges. What steps do i need to take?

    Unfortunately, it is not up to the property owners. Only the government can file criminal charges. Once the police are involved and charges are filed, the district attorney is the only person that can drop the charges. The fact that the property owners are willing to forgive and forget is good news, but it doesn't mean the charges will go away. I'd recommend hiring an attorney and if you cannot afford one you should seek to have the public defender appointed.

    It's really hard to say what your options are going to be or how strong your case is without analyzing the police reports. These types of cases can be very defensible. I'd recommend contacting an attorney to learn more.
