    Obstructing is one of the Fort Collins police officers favorite and standard charges. If you dealt with numerous police officers there is likely video from one of their cars or from the glasses they wear.     It sounds like there may be more going on than you are aware of. Don't talk to any more law enforcement officers without having an attorney.     This type of thing is fairly common. You may want an investigator to interview the man if he didn't write out a statement, but in my experience civilians that do ride-a-longs with police are very pro law enforcement in their testimony. Your attorney can help you decide if they should be interviewed.

    Don't just pay a fine or plead guilty to the open container charge without speaking to an attorney first. If you are on unsupervised probation the district attorney has discretion to file a Complaint to Revoke your probation based on new charges. The ramifications for this minor charge could be huge based on the charge you are on probation for and your criminal history. No attorney can tell you how or if the new charge can be dismissed without speaking to you and reviewing the police reports first. Many attorneys on avvo.com offer free consultations.     You will most likely be fine. The amount of alcohol in over the counter cold medicine is very low and it shouldn't show up if you were taking the appropriate dosage. You have done the right thing in talking to your probation officer about it already. If you have been otherwise compliant on probation I would be surprised if your probation officer filed a Complaint to Revoke Probation.

    There are things that can be done to encourage the District Attorney to drop the charges and the protection order, but there is no magic formula. Charges are dismissed based on the evidence, the applicable law, and having an experienced defense attorney that can articulate your side of the case to the District Attorney. Your fiancé is facing county jail time and the possibility of going back to prison for violating his parole. I'd recommend you hire an attorney as soon as possible or have your fiancé seek representation from the public defender's office.
