Description: On October 18, 2003, Plaintiff Christopher Martin, age 2, was a passenger in a Kia Rio driving westbound on 4th Street in Hale Center, Texas, with his mother and stepfather, great-grandmother and cousins. As the vehicle crossed the railroad grade crossing at 4th Street, they were hit by a southbound freight train operated by BNSF Railway Company. The crossing had no gates or flashing lights, and witnesses testified that the freight train failed to blow its horn as it approached the crossing. Killed were Shatarica Martin (19), Denatzhia Moses (18 mos.), Jean Johnson (71). Christopher and his cousin, Natasha Johnson (11) received severe injuries.
